On 5/17/24 Governor Vetoed SB 212 and sent new draft to Legislature for Approval (https://lis.virginia.gov/cgi-bin/legp604.exe?241+sum+SB212).  

Summary of New Bill

• No distributor, operator, or host location licensee shall place or maintain any electronic gaming device within any host location's premises that is located within (i) 35 miles of any casino gaming establishment authorized pursuant to Chapter 41 (§ 58.1-4100 et seq.) of Title 58.1 of the Code of Virginia or (ii) 35 miles of any racetrack or satellite facility operated by a limited license holder.
• A gaming tax equal to 35 percent shall be imposed upon all gross profits generated from the play of electronic gaming devices.
